Please read these Terms of Service ("Terms") carefully before using the WARDOGS Database website or the WARDOGS Database Discord application.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms:

• Company (referred to as either "the Company", "We", "Us" or "Our" in these Terms) refers to WARDOGS Database.
• Website refers to WARDOGS Database, accessible from https://wardogs.tools, including any subdomains.
• Discord App refers to the WARDOGS Database bot and application available on Discord, including its slash commands, messages, embeds and any other interactions it provides.
• Service refers collectively to the Website and the Discord App.
• Discord refers to Discord Inc. and the Discord platform, which is governed by its own terms at https://discord.com/terms.
• Server refers to a Discord server (guild) to which the Discord App has been added.
• Server Administrator refers to any Discord user with permission to add the Discord App to a Server or to manage its configuration in that Server.
• Account means a unique account created for You to access Our Service or parts of Our Service, including by signing in through Discord or Steam.
• Linked Game Account refers to a WARDOGS game account that You have connected to Your Account.
• Content refers to any text, images, loadouts, lobby data, map markers, messages or other material submitted, posted or made available through the Service.
• Game refers to the video game WARDOGS, developed by Bulkhead and published by Team17.
• Third-party Service refers to any services or content (including data, information, products or services) provided by a third party that may be displayed, included or made available through the Service.
• You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment

These are the Terms governing the use of the Service and the agreement that operates between You and the Company. These Terms set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service — including by adding the Discord App to a Server or by using any of its commands — You agree to be bound by these Terms. If You disagree with any part of these Terms then You may not access the Service.

You represent that You are over the age of 13. The Company does not permit those under 13 to use the Service. If You use the Discord App, You must also meet the minimum age required by Discord in Your country.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company, available at https://wardogs.tools/privacy. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Website or the Discord App. Please read Our Privacy Policy carefully before using Our Service.

Not Affiliated with the Game

The Service is an independent, fan-made project. The Company is not affiliated with, endorsed by, sponsored by or otherwise connected to Bulkhead, Team17 or any of their affiliates. WARDOGS and all related names, logos, artwork, in-game assets and data are the property of their respective owners and are used for informational and reference purposes only.

Game data shown on the Service (including item statistics, maps, progression and leaderboards) is derived from the Game, its public API and community contributions. It may be incomplete, out of date or inaccurate, particularly during beta periods, and may change without notice when the Game is updated.

Accounts and Linked Game Accounts

When You create an Account by signing in through Discord or Steam, You are responsible for safeguarding access to that third-party account and for all activity that occurs under Your Account.

You may link a WARDOGS game account to Your Account to enable leaderboards, statistics tracking and related features. By doing so You confirm that the Linked Game Account belongs to You and You authorise Us to retrieve data associated with it from the Game's API. You may unlink a Linked Game Account at any time from Your account settings.

You must not link a game account that You do not own or have permission to use, and You must not use the Service to obtain data about other players beyond what the Service makes publicly available.

The Discord App

Adding the Discord App to a Server

By adding the Discord App to a Server, the Server Administrator confirms that they have the authority to do so and agrees to these Terms on behalf of that Server. Server Administrators are responsible for configuring the Discord App appropriately, including which channels it may post in and which members may use its commands.

The Discord App requests only the permissions it needs to operate. Server Administrators may remove the Discord App from a Server at any time, after which the Company will cease processing new data from that Server in accordance with Our Privacy Policy.

Use of the Discord App

The Discord App provides access to Game data, player statistics, leaderboards and related features from within Discord. Content posted by the Discord App in a Server is visible to anyone who can view that channel, and the Company is not responsible for who a Server Administrator chooses to grant such access to.

Your use of Discord, including any interaction with the Discord App, is also subject to the Discord Terms of Service, Community Guidelines and Developer Policy. In the event of a conflict between these Terms and Discord's terms regarding Your use of the Discord platform itself, Discord's terms prevail.

Availability

The Discord App depends on Discord and on the Game's API, both of which are outside Our control. The Company does not guarantee that the Discord App will be available, uninterrupted or error-free, and may modify, suspend or discontinue it at any time.

Acceptable Use

You agree not to use the Service:

• In any way that violates any applicable law or regulation, or the terms of service of Discord, Steam, the Game or any other Third-party Service.
• To abuse, harass, threaten or intimidate other users.
• To submit Content that is unlawful, defamatory, obscene, hateful or otherwise objectionable.
• To attempt to gain unauthorised access to the Service, other Accounts, or systems or networks connected to the Service.
• To scrape, crawl, mass-download or otherwise extract data from the Service by automated means without Our prior written permission, other than through public interfaces expressly provided for that purpose.
• To interfere with or disrupt the Service, including by sending excessive requests, spamming the Discord App's commands, or attempting to circumvent rate limits.
• To manipulate leaderboards or statistics, including by linking game accounts You do not own or by submitting falsified data.
• To reverse engineer, decompile or otherwise attempt to derive the source code of the Service, except to the extent permitted by applicable law.
• To resell, redistribute or commercially exploit the Service or its data without Our prior written permission.

User Content

The Service may allow You to submit Content, such as loadouts, map markers, lobby information and supply requests. You retain any rights You hold in Your Content. By submitting Content, You grant the Company a non-exclusive, worldwide, royalty-free licence to use, store, display, reproduce and distribute that Content for the purpose of operating, improving and promoting the Service.

You are responsible for the Content You submit and represent that You have the right to submit it. The Company may remove or refuse to display any Content at its sole discretion, including Content that violates these Terms.

Content You share in public areas of the Service (such as public loadouts, lobbies or leaderboard profiles) may be viewed by other users and by anyone who can access the relevant Discord channel.

Intellectual Property

The Service and its original content (excluding Content provided by users and assets belonging to the Game's rights holders), features and functionality are and will remain the exclusive property of the Company and its licensors. The Service is protected by copyright and other laws of the United Kingdom and foreign countries. Our name and logos may not be used in connection with any product or service without the prior written consent of the Company.

Advertising and Links to Other Websites

The Website is supported by advertising provided through Third-party Services as described in Our Privacy Policy.

Our Service may contain links to third-party websites or services that are not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for, the content, privacy policies or practices of any third-party websites or services. You acknowledge and agree that the Company shall not be responsible or liable for any damage or loss caused or alleged to be caused by or in connection with the use of any such content, goods or services available on or through any such websites or services.

Termination

We may terminate or suspend Your access to the Service, remove the Discord App from a Server, or delete Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms.

Upon termination, Your right to use the Service will cease immediately. You may terminate Your Account at any time by deleting it from Your account settings or by contacting Us. Server Administrators may terminate a Server's use of the Discord App by removing it from the Server.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its affiliates and licensors, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice.

Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free, or that any errors or defects can or will be corrected. The Company makes no representation as to the accuracy of any Game data, statistics or leaderboards displayed through the Service.

Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. In such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service, or £10 GBP if You haven't purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, business interruption, personal injury, loss of privacy, or any other loss arising out of or in any way related to the use of or inability to use the Service, Third-party Services or the Discord platform), even if the Company or any supplier has been advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

Governing Law

The laws of England and Wales, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service. Your use of the Service may also be subject to other local, state, national or international laws. If You are a consumer in the European Union or the United Kingdom, You will benefit from any mandatory provisions of the law of the country in which You are resident.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

Severability and Waiver

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter, nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Changes to These Terms

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect, by posting a notice on the Website and/or in Our Discord server. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the Website and remove the Discord App from any Server You administer.
